OBSERVATIONS AND CORRECTIVE ACTIONS

10 6-301.12: Hand Drying Provision. At 8/25/25 inspection paper towels are not in the dispenser at the handwashing sink by the ice machine. PIC corrected on-site and put paper towels in the dispenser.
16 4-601.11(A): Equipment, Food-Contact Surfaces, Nonfood-Contact Surfaces, and Utensils. At 8/25/25 inspection the ice machine has some brown mold and stains at the inside top. Showed PIC the areas that need to be cleaned and sanitized. Keep ice machine regularly serviced, cleaned, and sanitized.
51 5-202.13: Backflow Prevention, Air Gap. At 12/27/24 inspection the pipe for the 3 compartment sink and the pipe for the ice machine were down in the drain. Pipes should be at least 1 inch above the rim of the drain to prevent contamination during backflow. At 8/25/25 inspection the pipe for the 3 compartment sink is still down in the drain. This is a repeat violation. Make sure to adjust the pipe for the ice machine so that it is at least 1 inch above the drain to prevent backflow contamination.
55 6-501.11: Repairing-Premises, Structures, Attachments, and Fixtures-Methods. At 8/25/25 inspection the 3 compartment sink has a leak. There is water all over the floor at the 3 compartment sink. PIC stated a work order was put in for repair but date this was done is unknown. Repair or fix the leak as soon as possible.
8 2-301.14: When to wash. At 8/25/25 inspection employee took off gloves and began putting on new gloves without washing hands. Inspector redirected employee, employee corrected on-site discarded gloves, washed hands and put on new gloves. Person In Charge (PIC) came from restroom inspection with inspector. PIC returned to serving area and began without washing hands. Inspector redirected PIC, PIC corrected on-site and washed hands. Hands must be washed prior to putting on new gloves and prior to changing tasks when working with food.
ADDITIONAL COMMENTS
  1. PIC stated there are biohazardous clean up kits for the establishment. Gave PIC the Cochise County Vomit & Fecal Clean Up Form to accompany the kits.

  1. This inspection is conducted under the authority of Arizona Revised Statutes ("A.R.S.") Title 36, Chapter 39, Article 1; Chapter 1, Article 2; and Chapter 6, Article 1 and Arizona Administrative Code ("A.A.C.") Title 9, Chapter 8, Articles 1-8 and 13.
  2. Some of the activities during the inspection may include, but are not limited to, a facility premise inspection, review of records, interview with staff, and review of services offered.
  3. The purpose of this inspection is to:
  4. An authorized on-site representative of the regulated person may accompany the agency inspector or regulator on the premises, except during confidential interviews;
  5. You have the right to have:
  6. Each person who has a conversation with the agency inspector or regulator during the inspection that is tape recorded will be informed that the conversation is being tape recorded.
  7. Each person interviewed will be informed that statements made by the person may be included in the inspection report. Participation in the interview is voluntary unless the person is legally compelled to participate in the interview. The person is allowed at least 24 hours to review and revise any written witness statement that is drafted by the agency inspector, auditor or regulator and on which the agency inspector, auditor or regulator requests the person's signature. The inspector, auditor or regulator may not prohibit the regulated person from having an attorney or any other experts in their field present during the interview to represent or advise the regulated person.
  8. You and your staff have the opportunity to provide any information that would clarify an issue. You also have the opportunity to correct any deficiencies identified during the inspection unless contrary to state or federal law or unless the agency determines that the deficiencies are intentional, not correctable within a reasonable amount of time, evidence of a pattern of noncompliance, or a risk to any person, public health, safety, welfare or the environment.

41-1001.01. Regulatory bill of rights; small businesses

  1. To ensure fair and open regulation by state agencies, a person
    1. Is eligible for reimbursement of fees and other expenses if the person prevails by adjudication on the merits against an agency in a court proceeding regarding an agency decision as provided in section 12-348.
    2. Is eligible for reimbursement of the person's costs and fees if the person prevails against any agency in an administrative hearing as provided in section 41-1007.
    3. Is entitled to have an agency not charge the person a fee unless the fee for the specific activity is expressly authorized as provided in section 41-1008.

The agency shall create the small business bill of rights by selecting the applicable rights prescribed in this section and section 41- 1009 and any other agency-specific statutes and rules. The agency shall provide a written document of the small business bill of rights to the authorized on-site representative of the regulated small business. In addition to the rights listed in this section and section 41- 1009, the agency notice of the small business bill of rights shall include the process by which a small business may file a complaint with the agency employees who are designated to assist members of the public or regulated community pursuant to section 41-1006. The notice must provide the contact information of the agency's designated employees. The agency notice must also state that if the regulated person has already made a reasonable effort with the agency to resolve the problem and still has not been successful, the regulated person may contact the office of ombudsman-citizens aide.
